Responsible Person and the European Cosmetic Regulation

The European Cosmetic Regulation EC 1223/2009 sets out the actions required in order for a cosmetic to be placed legally onto the UK & EU markets. Central to this is the role of the Responsible Person which is defined within the Regulation and put simply they have overall legal responsibility for compliance of their products. The Responsible Person must currently be based in the UK or another EU member state and their name and address must appear on the product label.

Product Information File and Safety Assessment

The Cosmetic Regulation requires that a Product Information File (PIF) is in place for each product. The PIF includes various data along with a Cosmetic Product Safety Report (CPSR). The CPSR must include a full European Safety Assessment conducted by a qualified person.

Cosmetic Product Testing

As set out in the CPSR details must be provided on the stability of the cosmetic product under reasonably foreseeable storage conditions. The CPSR also requires microbiological specification of the cosmetic product and the results of a preservation challenge test (PET). In addition, the CPSR requires relevant characteristics of packaging material, in particular purity and stability.

The product must be notified to the European Commission through the Cosmetic Product Notification Portal (CPNP) before it is put onto the EU market.
