For a cosmetic product to be legally placed onto the UK and/or the European market a Responsible Person must be appointed under the relevant Cosmetic Regulation. The Responsible Person is a key role within the Regulation(s) and put simply they have overall legal responsibility for compliance of their products.

The Responsible Person for the UK must be based in the UK; the Responsible Person for the EU market must be established in the EU community. Their name and address must appear on the product label.

Product Information File and Safety Assessment

The Cosmetic Regulation(s) require that a Product Information File (PIF) be in place for each product. The PIF includes various data along with a Cosmetic Product Safety Report (CPSR).

Cosmetic Product Labels and Claims

Cosmetic Product Testing

As set out in the CPSR details must be provided on the stability of the cosmetic product under reasonably foreseeable storage conditions. The CPSR also requires microbiological specification of the cosmetic product and the results of a preservation challenge test (PET). In addition, the CPSR requires relevant characteristics of packaging material, in particular purity and stability.

Notification of the Cosmetic Product to the relevant Authority

Each cosmetic product must be notified before it is put onto the market.

For the UK, the UK Submit Cosmetic Product Notification (SCPN) service must be used. For the EU it is the European Commission’s database, the Cosmetic Product Notification Portal (CPNP).
